The EMC directive is numbered 2014/30/EU, which will come into effect on April 18, 2014. The old EMC directive, 2004/108/EC, will be repealed in April 20, 2016.

New directive covers products including new products on the EU market, and in different forms of supply products, including remote sales products. But it does not apply to special evaluation suites that can be used solely for research and development facilities. The Distributor shall make reasonable transitional arrangements before placing this order (2014/30/EU) fully in place of the old order (2004/108/EC), placing the order product (i.e. the equipment already supplied to the distribution chain) on the market.

The new directive clearly states the obligations and responsibilities of the various operators, producers, authorized representatives, distributors, importers and their respective products, in the supply chain and the sales chain.

The new directive sets out detailed requirements for the notification of conformity assessment bodies (Conformity, Assessment, Bodies). All the requirements and obligations of the notified institution are specified in detail. It also details all the requirements, obligations, applications, changes, operations, appeals and coordination of the Notified (Bodies).  

In the new directive, special mention is made to the basic requirements of certain aspects that manufacturers may choose to reduce the application for conformity assessment procedures through internal production control methods. For other basic requirements, the type conformity assessment can be carried out based on the internal production control method according to the European Union type inspection procedure.

The new directive also incorporates new requirements in the technical documentation:

- design concepts and make images, as well as component solutions, subcomponents, principles, etc.;

- necessary descriptions and descriptions to understand those images and scenarios, as well as to understand the operation of the device

Manufacturer shall affix CE mark on each individual device, in order to meet the requirements of the appropriate instructions. The manufacturer shall also prepare a written EU compliance statement for the equipment model. When the device has been put on the market, the statement should be kept together with the technical documentation. Until 10 years later, they can be disposed of through state agencies. The official form of non conformity is also indicated in the new directive. The new directive pointed out that any member shall require the relevant economic operators do not meet the correct condition, or the relevant member states shall take all appropriate measures to restrict or prohibit has been provided in the market of equipment, or to ensure that the equipment in the market is to recall or withdrawal.

Each member state shall formulate the relevant penalty rules, which are suitable for use by operators in violation of state law. Member States shall take all necessary measures to ensure the implementation of the rules of punishment. These penalties may include criminal penalties for serious violations.
